The registration process is carried out electronically through the Spanish Ministry for the Ecological Transition and the Demographic Challenge.

What Is Spain EPR Filing?

Spain EPR filing refers to the periodic reporting of information concerning packaging placed on the Spanish market.

Under Spain’s current packaging reporting framework, registered producers or their authorised representatives must collect information about packaging introduced into the Spanish market during the relevant calendar year and submit it to MITECO.

The information can include packaging quantities and relevant material categories.

Accurate packaging data is therefore essential for businesses that have Spain EPR obligations.

Spain EPR Annual Filing Deadline

The general annual reporting deadline for packaging information is 31 March of the following year. For example, packaging data relating to a calendar year is generally reported by 31 March of the following year. For 2026 packaging data, MITECO states that the reporting procedure is scheduled to be open from 2 January 2027 until 31 March 2027. Businesses should maintain their packaging records throughout the year instead of waiting until the filing deadline to calculate the information required.

What Happens If You Do Not File Spain EPR?

Failure to submit required packaging information within the applicable deadline can result in an administrative infringement under Spanish legislation.

MITECO specifically states that failure to submit the declaration within the required period constitutes an administrative infringement.

Businesses should therefore treat EPR filing as an ongoing compliance responsibility rather than a one-time registration exercise.

E-commerce businesses should pay particular attention to packaging EPR. A business selling products directly to Spanish customers may have obligations relating not only to the original product packaging but potentially to other packaging introduced into the market through its sales and fulfilment model.

The new EU framework also changes certain rules affecting online platforms and producer status from 12 August 2026. MITECO has published specific guidance explaining how the new rules affect platforms and other operators.
